To what extent does the use of BIM alter the traditional allocations of risk in design and construction contracts?
This session focuses on the potential contractual and legal pitfalls attendant to using BIM technology.
Commencing with a discussion of the relationship of BIM to Integrated Project Delivery (“IPD”) this course will explore concerns for both the designer and the contractor ranging from topics such as design responsibility, standard of care, responsibility for software issues, status of BIM Models, reliance on models, and intellectual property concerns.
We will also examine the extent to which current insurance coverages are adequate for the various parties on a BIM project. Participants will become familiar with the industry’s attempts to provide contract models for use on BIM projects by exploring the ConsensusDOCs CD301 – BIM Addendum and AIA E202 – BIM Protocol Exhibit.
The session will conclude with an examination of practical BIM guidelines and a definition of realistic BIM protocol goals for both the contractor and the designer.
